BOOKING TERMS FOR BABYSITTING SERVICES

  1. Parties and Nature of the Booking

    1.1 Each booking made through the Faye’s Sitters platform constitutes a legally binding contract for childcare services solely between the babysitter who accepts the booking (“Babysitter”) and the parent or guardian who makes the booking (“Customer”).
    1.2 Faye’s Sitters Limited acts only as an introduction agent and booking facilitator. We do not provide childcare services and are not a principal or party to the childcare contract.
    1.3 Babysitters are independent service providers and are not employees, workers, or agents of Faye’s Sitters Limited.

  2. Role of Faye’s Sitters Limited

    2.1 Our role is limited to:
    Introducing Babysitters to Customers

  • Facilitating bookings through the platform

  • Processing payments, where applicable, as agent for Babysitters

  • Maintaining verification and safeguarding.

2.2 We do not supervise Babysitters during a booking and do not control how childcare services are delivered.

3. Formation of a Booking Contract

3.1 A booking contract is formed when:

  • A Customer submits a booking request and accepts these Booking Terms, and

  • A Babysitter accepts the booking through the platform.

3.2 Once accepted, the booking becomes binding subject to these Booking Terms.

  1. Booking Details
    4.1 Each booking will specify the date, start time, end time, location, Babysitter’s hourly rate, and any care information provided by the Customer.
    4.2 Customers are responsible for ensuring that all information provided is accurate, complete, and up to date.

  2. Payments and Booking Fee
    5.1 At the time a booking is made, the Customer pays a non-refundable platform booking fee of £7 to Faye’s Sitters Limited, subject to the cancellation terms set out below.
    5.2 The booking fee is separate from and does not reduce the Babysitter’s fee.
    5.3 The Babysitter’s fee is not charged at the time of booking and becomes payable only after the babysitting services have been completed.
    5.4 If a booking does not take place for any reason, no Babysitter fee will be charged.
    5.5 Payments for babysitting services are collected and paid using one of the following payment methods, as determined by the platform for each booking:
    a. Stripe Connect automated payment
    Where Stripe Connect is used, the Babysitter’s fee will be automatically charged to the Customer’s saved payment method after the sit has been completed. Funds will be paid directly to the Babysitter via Stripe, with Faye’s Sitters Limited acting as payment agent only.
    b. Bank transfer
    Where bank transfer is used, Faye’s Sitters Limited will provide the Customer with the Babysitter’s bank details at the end of the sit. Customers must complete payment in full within 24 hours of receiving these details.
    5.6 If payment is not received within 24 hours where bank transfer is selected, Faye’s Sitters Limited reserves the right to collect the outstanding Babysitter’s fee automatically via Stripe using the payment method provided by the Customer at the time of booking.
    5.7 By making a booking, Customers authorise Faye’s Sitters Limited to take payment in accordance with this Section 5 and acknowledge that failure to complete payment by bank transfer may result in automated card collection.

  3. Customer Cancellations
    6.1 If a Customer cancels a booking more than 24 hours before the scheduled start time, 50 percent of the £7 booking fee will be refunded.
    6.2 If a Customer cancels within 24 hours of the scheduled start time, the booking fee is non-refundable.

  4. Babysitter Cancellations and Replacement
    7.1 If a Babysitter cancels a confirmed booking, Faye’s Sitters Limited will make reasonable efforts to source a replacement Babysitter.
    7.2 Faye’s Sitters Limited does not guarantee that a replacement Babysitter will be available and shall not be liable if a replacement cannot be found. In such circumstances, the booking fee will be refunded.

  5. Responsibilities of Customers
    Customers agree to:
    Provide accurate information about children, care needs, and the booking location

    • Ensure a safe and appropriate environment for childcare

    • Be reachable during the booking as agreed

    • Promptly report any incidents or concerns

  6. Responsibilities of Babysitters
    Babysitters agree to:
    Provide childcare services with reasonable care and skill

    • Follow safeguarding requirements and care instructions

    • Notify Faye’s Sitters Limited immediately of any incident, accident, or safeguarding concern

  7. Safeguarding and Incidents
    10.1 Any incident, accident, or safeguarding concern arising during a booking must be reported to Faye’s Sitters Limited as soon as reasonably possible.
    10.2 Faye’s Sitters Limited may investigate incidents and take appropriate action, including suspension or removal from the platform.

    10.3 Any such action is taken for platform safety and compliance purposes only and does not imply responsibility for the provision of childcare services.

    11. Liability and Insurance
    11.1 Babysitters are solely responsible for the childcare services they provide under each booking contract.
    11.2 Faye’s Sitters Limited does not provide insurance cover for Babysitters in respect of childcare services and makes no representation that such services are insured.
    11.3 Customers acknowledge that babysitting services are provided by independent Babysitters and not by Faye’s Sitters Limited.
    11.4 Nothing in these Booking Terms limits or excludes liability that cannot be limited or excluded by law.

    12. Complaints
    12.1 Complaints relating to a booking should be raised promptly.
    12.2 Faye’s Sitters Limited may assist in resolving disputes but does not accept responsibility for the performance of childcare services.

    13. Governing Law
    These Booking Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
